BSK Ministry of Law Seeks ITB DKST Input for Reformulation of Patent Application Rules

Blung,dkst.itb.ac.id-On Wednesday, April 30, 2025, the National Policy Policy Department (BSK) had a visit and a discussion with the Uniform Institute of Technology (ITB) through the Directorate of Science and Technology (DKST ITB) in order to evaluate the implementation of the Minister of Law and Human Rights Number 38 in 2018 about the Appen Request. Meeting in the 7th floor conference room, ITB Building 2 Innovation Park Technopolis.

This discussion is part of an exhibition-regulation evaluation process that has not been fully aligned with the development of the new Office in patents. The BSK Ministry is assessing the need for a substantial revision of the Permenkhamm, especially in terms of the application process and patent check. This visit will be the basis of forming new regulations that are more relevant and operational to my players of interest.

In the discussion forum, the DKST ITB team delivered a number of crucial issues often facing inventors and institutional intellectual property administrators. One of the main issues that was taken was not yet signed by the requisition system and the DJKI system, which resulted in delay and even failure of letter-writing during the patent substantial process.

The standard evaluation by the inspectors is also an important spotlight. It is said that the distinction between DJKI inspectors often leads to uncertainty in the process of assessment of request substance. The default abbreviation of writing patent descriptions creates a diverse interpretation, both in training and in application review practice.

"The examination substance is sometimes unclear, whether it concerns the content or simply the writing code. It needs to be made explicit technical standards not to rely on the interpretation of inspectors, "says one of the DKST ITB representatives.

Reformulation Required to Adjust Field Practics

One of the points of discussion that arises is about the time period of a substantial examination which in practice tends to exceed the 36-month deadline as arranged. The limitation of the number of human resources becomes one factor of the cause of the application buildup.

Then, in the patent domainlife science, discussion participants also highlighted yet to exist default standard for scaly order of corpse, which is often the reason for the return of the request. The lack of technical funding and yet available formal examples becomes its own challenge in this realm.

Moreover, the process of diverting patents from institutions to companies is also still complicated. Long administrative requirements, such as waarmerking and command signatures, slow down the commercial processes that should be more dynamic.

BSK Ministry has stated that one of the main goals of regulatory revision is to simplify the process and accelerate the legal output, including the application of a secure digital patent certificate and have high data integrity. This idea is welcome by discussion participants, with a note of the importance of protection against the authenticity and security of that digital information.

Meanwhile, the need to repair the digital system and migration of the old database is also recognized as an issue that needs to be handled technically and consistently.

This discussion became a significant first step in forming a more efficient, transparent, and more in favor of the development of national innovation. Collaboration between BSK Francis, academic manufacturing institutions such as ITB, as well as DJKI are expected to encourage regulatory reform that is not only normal, but also responsive to field challenges.
